What Is California Proposition 65?

Proposition 65, formally known as the Safe Drinking Water and Toxic Enforcement Act of 1986, is a California state law that requires businesses to provide clear and reasonable warnings before knowingly exposing anyone to chemicals listed by California as known to cause cancer, birth defects, or other reproductive harm.

The law is administered by California's Office of Environmental Health Hazard Assessment (OEHHA). OEHHA maintains an official list of chemicals — currently over 900 substances — that must be disclosed when a product contains them above established threshold levels.

A Proposition 65 warning does not mean a product is unsafe or illegal. Many naturally occurring substances, including trace minerals found in organic soil amendments, appear on the Prop 65 list. The warning simply means that California law requires us to inform you of their presence so that you can make an informed decision.

Businesses with fewer than ten employees and certain government agencies are exempt from Prop 65. All other businesses selling products that may expose California residents to listed chemicals are required to provide warnings regardless of where the business is located. Organic Worm Castings

Organic worm castings are a naturally derived vermicompost product. As a soil amendment produced from organic matter, worm castings may contain naturally occurring trace concentrations of lead, cadmium, nickel, and other heavy metals that are present in the organic feedstocks used in the composting process. These metals appear on the California Prop 65 list. Their presence in worm castings reflects the natural mineral content of organic matter and soil, not the addition of synthetic chemicals.

Worm castings are intended for use as a soil amendment applied to garden beds, planters, and containers. Direct ingestion is not intended. Customers should avoid ingesting the product, keep it away from children who may place hands in their mouths after contact, and wash hands after use. For outdoor use, standard gardening hygiene practices are sufficient.

Raised Garden Beds

Prop 65 Warning

Raised garden beds may be constructed from or include materials such as galvanized steel, powder-coated metal, treated wood, or composite materials. Some of these materials may contain or off-gas trace quantities of listed Prop 65 substances including lead (in certain coatings or metal alloys), chromium compounds, or other substances used in manufacturing or surface treatment processes.

We recommend wearing gloves when assembling metal garden beds, washing hands after handling any hardware components, and avoiding prolonged skin contact with raw metal edges. Do not burn or cut treated wood components in enclosed spaces.

Planters

Planters sold by Rdy2Gro Soil Systems may be manufactured from plastics, metals, or composite materials. Certain plastic formulations and metal components may contain phthalates, lead compounds, bisphenol A (BPA), or other substances listed under Proposition 65. Dyes, pigments, and stabilizers used in manufacturing plastic planters may also contribute to listed substance content.

Planters are intended for outdoor gardening use. Avoid using planters for food storage or water consumption. Keep out of reach of children who may chew on plastic components. Wash hands after extended handling.

Trellises & Garden Supports

Prop 65 Warning

Trellises and garden support structures may contain steel, iron, coated wire, or plastic components. Metal hardware, welds, and surface coatings used in trellis manufacturing may contain trace levels of lead, nickel, or chromium compounds that are listed under Proposition 65. Wire coatings may also include plasticizers that appear on the Prop 65 list.

Use gloves when installing metal trellis systems. Avoid contact between bare metal and edible plant parts. Wash hands after installation or adjustment. Do not use metal trellises in ways that concentrate heat or cause burning of coatings.

Shade Cloths

UV Fabric • Assessment Ongoing

Current Status Shade cloths are woven polyethylene or polypropylene UV-resistant fabrics intended for outdoor garden use. Based on current supplier documentation, shade cloths sold by Rdy2Gro Soil Systems do not contain known Prop 65-listed substances at concentrations above established California threshold levels. However, as UV stabilizers and colorants vary by manufacturer and production batch, we continue to review supplier documentation for any changes to material composition.

Shade cloths are designed for outdoor use only. Do not burn or cut shade cloth in enclosed spaces, as heated synthetic fabrics may release compounds. Wash hands after extended handling. If you have specific concerns about a shade cloth product, contact us before purchasing and we will provide available material documentation.

How to Reduce Your Exposure

A Prop 65 warning does not mean you should avoid a product. It means you should use it responsibly. The following safe use practices reduce your exposure to listed substances when using Rdy2Gro Soil Systems products.

Wash Hands After Use

Always wash your hands with soap and water after handling organic worm castings, garden soil, metal hardware, or any garden product. This is the single most effective way to reduce incidental ingestion of trace substances.

Wear Protective Gloves

Use gloves when handling soil amendments, assembling metal garden structures, or doing extended gardening work. Gloves reduce skin absorption and the transfer of soil particles to your face and mouth.

Keep Children Safe

Children are more susceptible to chemical exposure than adults. Keep worm castings, fertilizers, and garden hardware out of reach of young children. Supervise children during garden activities and ensure they wash hands thoroughly afterward.

Avoid Dust Inhalation

When applying dry worm castings or working with fine soil amendments in windy conditions, consider wearing a dust mask or respirator. Avoid stirring up dust unnecessarily. Apply amendments to moist soil where possible.

Use Products as Intended

Do not use garden products for any purpose other than their intended garden use. Worm castings are a soil amendment and are not intended for ingestion by humans or pets. Garden structures are not food contact surfaces.

Store Products Safely

Pregnant & Nursing Individuals

Pregnant women, women planning to become pregnant, and nursing mothers should take additional precautions when handling soil amendments and garden hardware. Minimizing direct contact and always wearing gloves and washing hands is especially important.

A Note on Organic Products

The trace substances identified in our organic worm castings are naturally occurring minerals inherent to organic matter and soil. They are not added during production. The levels present reflect natural geochemical concentrations in composted organic feedstock and are comparable to what you would encounter in any garden soil. Standard gardening hygiene practices — washing hands, wearing gloves, avoiding ingestion — are all that is needed for safe use.

State-Specific Chemical Disclosure & Safety Laws

California's Prop 65 is the most comprehensive state chemical disclosure law in the United States, but several other states have enacted or are developing similar consumer protection requirements. Below we outline the current regulatory landscape across key U.S. states where our products are sold.

California

Governed by the Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65), administered by OEHHA. Businesses must provide clear and reasonable warnings before any exposure to listed chemicals. We issue all required warnings on this page and on applicable product listings. Washington State

Washington has enacted the Children's Safe Products Act (CSPA) (RCW 70A.430), which requires manufacturers to report the use of Chemicals of High Concern to Children (CHCC) in products sold to children under 12. For adult-use garden products, Washington follows federal CPSC standards. We comply with applicable WSDA soil amendment labeling rules for our organic worm castings.

Oregon

Oregon follows federal EPA and CPSC standards for chemical disclosure in consumer products. The Oregon Department of Agriculture regulates soil amendments, including worm castings, under OAR Chapter 603. Our worm castings comply with applicable Oregon Dept. of Agriculture registration and labeling requirements. Oregon does not have a Prop 65 equivalent for adult consumer products at this time.

New York

New York has enacted the Toxic Toys Act and various child safety chemical restrictions under New York Agriculture and Markets Law and Environmental Conservation Law. The NYS Dept. of Environmental Conservation maintains a list of chemicals of concern. Our products for adult garden use comply with applicable NY standards. We also comply with NY fertilizer and soil amendment labeling under Agriculture and Markets Law Article 12-A.

Massachusetts

Massachusetts follows federal CPSC regulations for consumer products. The MA Dept. of Environmental Protection (MassDEP) regulates hazardous waste and toxic substances under MGL Chapter 21C and 21E. No Prop 65 equivalent applies to our product types in Massachusetts at this time. Standard safe use practices are sufficient for MA customers.

Connecticut

Connecticut has enacted chemical transparency provisions under CGS Chapter 446j governing pesticides and soil treatments. The CT Dept. of Energy and Environmental Protection (DEEP) oversees chemical management. No Prop 65 equivalent currently applies to our specific product types in Connecticut. We follow all applicable federal standards.

Minnesota

Minnesota has enacted the Toxic Free Kids Act (Minn. Stat. Chapter 116J) requiring manufacturers to report chemicals of high concern in children's products. For adult garden products, MN follows federal CPSC rules. The Minnesota Dept. of Agriculture regulates soil amendments under Minn. Stat. Chapter 18C. Our worm castings comply with MDA standards for organic soil amendments sold in Minnesota.

Vermont

Vermont has enacted Act 188, the Consumer Product Safety Act for children's products, which requires disclosure of chemicals of concern in products for children. For adult garden tools and soil amendments, Vermont follows federal standards. The VT Agency of Agriculture, Food and Markets (VAAFM) regulates soil amendments. We comply with applicable VAAFM labeling requirements.

Maine

Maine's Kid-Safe Products Act (38 MRSA Chapter 16-D) governs chemical disclosure in children's products. Maine has also enacted LD 1911 expanding chemical safety reporting. Adult garden products follow federal CPSC requirements. The Maine Dept. of Agriculture, Conservation and Forestry regulates soil amendments under Maine Statute Title 7. We comply with applicable DACF requirements for products shipped to Maine.

Illinois

Illinois follows federal CPSC standards for consumer product chemical safety. The Illinois Dept. of Agriculture (IDOA) regulates fertilizers and soil amendments under the Illinois Fertilizer Act (505 ILCS 85). Our organic worm castings comply with IDOA registration and labeling requirements for soil conditioners distributed in Illinois.

Texas

Texas does not have a Prop 65 equivalent. The Texas Dept. of Agriculture (TDA) regulates soil amendments and fertilizers under the Texas Fertilizer Control Act. The Texas Commission on Environmental Quality (TCEQ) oversees environmental chemical regulations. Our products comply with all applicable TDA labeling and registration requirements for soil amendments sold in Texas.

Florida (Our Home State)

As a Florida-registered LLC, we are regulated by the Florida Dept. of Agriculture and Consumer Services (FDACS) under Florida Statutes Chapter 576 (Fertilizers) and Chapter 487 (Plant Pest and Disease Control). Our worm castings are registered and labeled in compliance with FDACS soil amendment regulations. Florida does not have a Prop 65 equivalent; our California-standard warnings apply to any Florida customer who wishes to be informed.

Arizona

The Arizona Dept. of Agriculture (AZDA) regulates soil amendments, fertilizers, and plant growth substances under Arizona Revised Statutes Title 3, Chapter 2. Our worm castings comply with AZDA labeling and nutrient disclosure requirements. Arizona does not have a state chemical disclosure law comparable to Prop 65 for adult consumer products.

Colorado

Colorado follows federal CPSC and EPA standards for consumer product safety. The Colorado Dept. of Agriculture (CDA) regulates soil amendments under 35 C.R.S. Article 12. Products shipped to Colorado comply with CDA labeling and registration requirements. Colorado does not have a Prop 65 equivalent for adult consumer products.

Hawaii & Alaska

Both Hawaii and Alaska impose USDA and state agricultural import restrictions on organic matter, soil amendments, and plant-based products to protect local ecosystems from invasive species and pests. Orders to Hawaii and Alaska may require additional documentation, permits, or inspection and may be subject to restrictions or refusal.
